3 — Conditional participation

3.1 Imposition of conditions

3.1.1 If the Vice-Chancellor's nominee considers that:

1. a student has engaged in general misconduct and/or misconduct as defined in Rule 16.12 of the UTS Student Rules; and/or
2. there is a risk that a student's attendance and/or participation at University will:
   1. interfere with or impair the reasonable freedom or ability of other people to:
      • pursue their studies or research;
      • carry out their duties, functions or lawful activities; or
      • otherwise participate in University life; and/or
   2. threaten:
      • their own health, safety or welfare; and/or
      • the health, safety or welfare of other student/s, staff or visitors to the University; and/or
   3. otherwise have a materially negative impact on the University, its students, staff or visitors,

then, irrespective of, and in addition to, any other University processes (including any misconduct proceedings under these Conduct Rules or the UTS Student Rules), the Vice-Chancellor's nominee may impose specific conditions on the student’s participation in any or all University activities indefinitely or for a specified period, including but not limited to conditions on:

3. the student attending all or any part of University campus; and/or
4. the student participating in any or all University activities.

3.1.2 Any condition imposed on a student's participation under this Rule 3.1 should be reasonable, proportionate and imposed for the period of time that is necessary.

3.1.3 A student whose participation is subject to a condition/s imposed under this Rule 3.1 should be informed of:

1. the reasons for the imposition of the condition/s;
2. the duration of the condition/s; and
3. the circumstances in which the Vice-Chancellor's nominee may review the condition/s.

3.2 Compliance with conditions

3.2.1 A student must comply with conditions imposed by the Vice-Chancellor's nominee under Rule 3.

3.3 Interaction between conditions and penalties

3.3.1 If the decision-maker decides to impose a penalty on a student under Rule 4.7.1 of these Conduct Rules or Rule 16.3 of the UTS Student Rules, then:

1. any condition that has been imposed on that student under Rule 3.1 of these Conduct Rules will cease to have effect under Rule 3, unless the student lodges an appeal under Rule 16.13 of the UTS Student Rules, in which case the condition will cease to have effect from the date on which the appeal is determined; and
2. the decision-maker may or may not decide to impose a penalty that includes terms with the same or similar effect as that condition.
