2.1 General conduct requirements

2.1.1 Each student must maintain an acceptable standard of conduct at all times. This means that each student must:

  1. comply with:
    1. the Act and any other legislation applicable to their involvement with the University;
    2. these Conduct Rules, the UTS Student Rules and any other rules made by the University, however those rules are named (for example, including any By-law);
    3. any codes of conduct, policies and procedures of the University in place from time to time; and
    4. all lawful directions of the University;
  2. be honest in their dealings with the University;
  3. not maliciously or otherwise unreasonably damage the good name, academic standing, good order and government of the University;
  4. act in a way that does not:
    1. disrupt the normal activities of the University, including its events; and/or
    2. compromise the safety of the University's people, or the security or integrity of University campus, property, facilities or systems; and
  5. not otherwise commit any act of misconduct as defined in Rule 2.2 below and/or in Rule 16.2 of the UTS Student Rules.

2.1.2 These Conduct Rules should be interpreted so as not to prevent a student from legitimately and lawfully:

  1. exercising academic freedom; or
  2. expressing themselves,

for example, through good-faith and lawful criticism, advocacy, participation in student representative activities, demonstrations or protests.

Note: The concepts of legitimate academic freedom and legitimate freedom of expression, and the circumstances in which a condition, prohibition or restriction can be imposed by the University without impairing those concepts, are explained in the Academic Freedom and Freedom of Expression Policy and the Campus Policy.

2.1.3 Nothing in these Conduct Rules prevents a student from making a complaint to an external body in accordance with relevant law.

2.2 General misconduct

2.2.1 General misconduct means any conduct that contravenes the University's conduct requirements, that is not also misconduct as defined in Rule 16.2 of the UTS Student Rules. General misconduct includes, but is not limited to:

  1. non-compliance with relevant law; that is, failing to comply with the Act, or any other legislation applicable to a student's involvement with the University;
  2. non-compliance with these Conduct Rules, the UTS Student Rules and/or any other rules, however those rules are named (for example, including any By-law), codes of conduct and/or policies and procedures made by the University and in place from time to time;
  3. deliberate or reckless behaviour that:
    1. disrupts the normal activities of the University, including its events; and/or
    2. compromises the safety, security or integrity of the University's premises, facilities or systems; and/or
    3. interferes with or impairs the reasonable freedom or ability of other people to:
      • pursue their studies or research;
      • carry out their duties, functions or lawful activities in the University; or
      • otherwise participate in University life; and/or
    4. interferes with, impairs or threatens the health, safety or welfare of other student/s, staff or visitors to the University; and/or
    5. damages University property or facilities;
  4. acting in a way that unlawfully discriminates against, vilifies, harasses, bullies or abuses another student, or an officer of the University, including without limitation by publishing any material in any forum or media;
  5. acting in a way that maliciously or otherwise unreasonably damages the good name, academic standing or good order and government of the University, including without limitation by publishing any false or misleading material in any forum or media;
  6. dishonesty in dealings with the University; that is, providing false or misleading or deliberately incomplete information, or making false statements or representations, to any officer of the University about anything to do with the student's participation at the University; or altering or falsifying any document or record of the University;
  7. stealing or destroying any University property; or
  8. failing to comply with the terms of any direction made under these Conduct Rules or the UTS Student Rules, including without limitation a penalty or requirement imposed for general misconduct or misconduct as defined in Rule 16.2 of the UTS Student Rules.

2.5 Compliance with Rules

2.5.1 Each student must agree to comply with the laws, rules and standards referred to in these Conduct Rules (including but not limited to Rule 2.1) and the UTS Student Rules by signing any declaration required by the University.

2.5.2 If the Vice-Chancellor's nominee considers that a student has not complied, or may not have complied with these Conduct Rules (including but not limited to Rule 2.1) and/or the UTS Student Rules, then the University may deal with the student as set out in Rule 3 (Conditional participation) and Rule 4 (Student misconduct and appeals) of these Conduct Rules and Section 16 of the UTS Student Rules, including by imposing penalties.
