Portfolio Entry Scheme – Terms and Conditions

  1. Introduction
     
    1.1 These Terms and Conditions (Terms) apply to the submission of a Portfolio (see Part 3) for admission consideration via the Portfolio Entry Scheme (Scheme) in an eligible Design, Architecture and Building (DAB) degree at the University of Technology Sydney (UTS).
     
    1.2 By submitting a Portfolio, an applicant (You or Your) agrees to comply with these Terms.

  2. Eligibility 
     
    2.1 The Scheme is open to applicants who meet the relevant Eligibility Criteria for an eligible undergraduate or graduate course (Course). 
     
    2.2 Eligibility Criteria for each course may differ, and You should refer to the relevant UTS website for further information about the specific criteria.

  3. Portfolio Requirements 
     
    3.1 The portfolio must include:  
     
     3.1.1 A cover letter aligning with the Eligibility Criteria explaining Your interest in studying the relevant Course at UTS’s DAB (Cover Letter); and  
     
    3.1.2 All relevant written, visual or other materials required by UTS as per the relevant Eligibility Criteria. 
    (together, the Portfolio).  
     
    3.2 The Portfolio must be Your original work and demonstrate the skills and abilities relevant to the Eligibility Criteria for the specified Course.  
     
    3.3 You acknowledge and agree that by providing false or misleading information (including plagiarised content) when submitting Your Portfolio may result in the rejection of Your application or disciplinary action by UTS (including suspension or expulsion from the Course or UTS if discovered after enrolment in the Course).

  4. Applicant Representations & Warranties  
     
    By applying to the Scheme, You represent and warrant that:  
     
    4.1 all work submitted is Your own and has not been copied, plagiarised, or misrepresented in any way;  
     
    4.2 You have the full rights to submit the Portfolio and grant any licences required by these Terms;  
     
    4.3 You are at least eighteen (18) years of age, or where this is not the case, Your parent or legal guardian will sign a copy of these Terms which will be provided to UTS along with Your Portfolio;  
     
    4.4 any upload feature on this site will only be used to submit a Portfolio and no other document(s);  
     
    4.5 no part of the submission provided to UTS will be unlawful; and  
     4.6 no part of the submission provided to UTS will contain a virus or other harmful code or component or is otherwise designed to introduce any trojan horse into UTS’s systems.

  5. Intellectual Property
     
    5.1 Subject to this clause 5, You retain all intellectual property rights in Your Portfolio. 
     
    5.2 By submitting a Portfolio, You grant UTS a royalty-free, non-exclusive license to review, assess, make copies, store, distribute, display, reproduce and transmit the Portfolio for the purpose of evaluating Your application to the Scheme.  
     
    5.3 In the event of a Portfolio is successful, You consent to UTS making any such copies of the Portfolio so that UTS may use, distribute, display, reproduce, adapt, transmit, and otherwise make publicly available Your Portfolio (excluding the Cover Letter) as an example for future applicants to the Scheme. This will be done on the condition that, unless otherwise agreed in writing, Your identity will not be disclosed. You hereby waive all moral rights in the Portfolio, allowing UTS to use, modify, and distribute the work in accordance with this clause 5.3 without further consent from you. You may at any time withdraw consent for UTS to use Your Portfolio in this way and seek that Your Portfolio be excluded as a ‘success example’ by notice to UTS in writing.  
     
    5.4 You must, at Your own expense, indemnify UTS and hold UTS, its directors, officers and employees, harmless from and against any and all claims, actions, liabilities, loses, damages, judgments, grants, costs and expenses brought or alleged by a third party based on any claim that Your Portfolio infringes upon a third party’s intellectual property rights.

  6. Privacy & Confidentiality  
     
    6.1 Personal information provided as part of Your Scheme application will be collected and processed in accordance with UTS’s Student Privacy Notice.  
     
    6.2 UTS will take reasonable steps to protect the confidentiality of your Scheme application (including, Your Portfolio), subject to any of the licenses granted.

  7. Disclaimers
     
    7.1 UTS reserves the right to modify, suspend, or terminate the Scheme at any time without prior notice.  
     
    7.2 Submission of a Portfolio does not guarantee You admission into UTS. Admission via the Scheme will be at UTS’s sole discretion. UTS’s decision is final; There will be no avenues for appeal.  
     
    7.3 UTS shall have no liability for any loss, damage or expense incurred by You in connection with Your participation in the Scheme, including but not limited to, loss of intellectual property or failure to gain admission to UTS; and  
     
    7.4 The Scheme website may contain links to other websites and resources. The presence of links is not an endorsement by UTS of the linked sites or their contents. Your access to those links is at Your own risk.

  8. General
     
    8.1 These Terms are governed by the laws of New South Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.  
     
    8.2 UTS may change or modify these Terms at any time. Updated Terms will become effective upon UTS posting those terms to this website.  
     
    8.3 These Terms are the entire agreement between UTS and You with respect to the operation of the Scheme. Other than in relation to the Eligibility Criteria (which appear elsewhere on the UTS website), no other document, resource or information is intended to be enforceable.  
     
    8.4 Any notice given to UTS in respect of these terms will give given via email to [insert] and to You at the email address included in Your Portfolio. Notice via email will be taken to be received once sent until the person sending the email receives an automatic notification that the email was rejected or if it was sent after 5pm or on a day which is not a Business Day, and then the email will be taken to be received at 9am the following Business Day. For the purpose of this clause 9.4 “Business Day” is a day which is not a Saturday, Sunday or public holiday in New South Wales.  
     
    8.5 If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed, and the remaining terms will continue in full force and effect.  
     
    8.6 Failure by UTS to enforce any provision of these Terms will not be considered a waiver of that provision of any other right(s) under these Terms.
